HIPAA and Workplace Testing

HHS HIPAA rules do not require employers and service agents in the DOT drug and alcohol testing program to obtain written employee authorization to disclose drug and alcohol testing information required by 49 CFR Part 40 and other DOT agency drug and alcohol testing rules.

If your company conducts pre-employment drug or alcohol screening and your company is NOT part of the DOT drug and alcohol testing program, then we will require a valid release form, signed by the candidate or employee before we can release the results.  Business Associate Addendums do not apply in this case.
